Terms of Service
Introduction
These Terms of Service ("Terms") govern your access to and use of the services provided by DentArt ("we," "our," or "us"), including our website, appointment bookings, treatments, and any related materials. By booking an appointment or accessing our website, you agree to be bound by these Terms.
Services
Scope of Services
DentArt provides a range of dental services including but not limited to general dentistry, cosmetic treatments, preventive care, orthodontics, and emergency dental consultations. The specific treatments and associated fees will be confirmed with each patient prior to commencement.
Initial Consultations
Initial consultations may be offered at no charge and do not constitute a binding treatment agreement. No treatment plan is confirmed until discussed and consented to in writing by the patient.
Treatment Plans
All recommended treatments, timelines, and estimated costs will be outlined in a personalised treatment plan. We will use reasonable efforts to meet estimated timelines, though these may vary depending on clinical factors outside our control.
Appointment Terms
Bookings
Appointments can be made online, by phone, or in person. A confirmed booking constitutes acceptance of these Terms. We reserve the right to reschedule appointments where necessary due to clinical or operational circumstances.
Cancellations and No-Shows
We require a minimum of 24 hours notice for cancellations or rescheduling. Late cancellations or missed appointments without notice may incur a cancellation fee as outlined at the time of booking.
Emergency Appointments
Emergency dental appointments are subject to availability. We will make every reasonable effort to accommodate urgent cases in a timely manner.
Fees and Payment
Payment Terms
All fees are confirmed prior to treatment commencement. Payment is due at the time of service unless a payment plan has been agreed upon in advance. Overdue accounts may be referred to a third-party collections service.
Health Fund Claims
DentArt supports claims through major health funds. Patients are responsible for understanding their own coverage. Any gap payments are the patient's responsibility and are due at the time of service.
Fee Adjustments
Fees are reviewed periodically and are subject to change. Updated fees will be communicated via our website or at your next appointment.
Intellectual Property
Website Content
All content on the DentArt website, including text, images, graphics, and logos, is the property of DentArt and may not be reproduced or distributed without prior written consent.
Patient Materials
Treatment plans, reports, and clinical documents provided to patients are for personal use only and may not be shared or reproduced without consent.
Confidentiality and Privacy
Patient Information
We are committed to protecting your personal and health information in accordance with applicable privacy legislation. Information collected during your care is used solely for the purpose of providing dental services and will not be shared with third parties without your consent, except where required by law.
Exceptions
Confidentiality obligations do not apply to information required to be disclosed by law or regulatory bodies.
Warranties and Limitations
Service Warranty
We warrant that all services will be performed by qualified dental professionals in accordance with accepted clinical standards. We do not guarantee specific aesthetic outcomes, as results may vary depending on individual patient factors.
Limitation of Liability
To the maximum extent permitted by law, DentArt's liability for any claims arising from treatment shall not exceed the total fees paid by the patient for that specific treatment. We are not liable for any indirect or consequential damages arising from the use of our services.
Termination
Ending the Patient Relationship
Either party may end the patient-provider relationship at any time. Patients will be provided with reasonable notice and referral options where appropriate. Outstanding fees for services rendered remain payable upon termination of the relationship.
General Provisions
Independent Practitioners
Treating clinicians at DentArt operate in accordance with their professional obligations and registration requirements. Nothing in these Terms limits a clinician's duty to act in the patient's best clinical interest.
Governing Law
These Terms are governed by the laws of the state or territory in which DentArt operates. Any disputes will be handled in accordance with applicable local legislation.
Amendments
We may update these Terms from time to time. Material changes will be communicated via our website. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
